Terms of Service – Nuvar Designs

These Terms of Service ("Terms") govern your use of nuvardesigns.com (the "Site") and any purchase you make from Nuvar Designs ("Nuvar Designs," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms, together with our Shipping Policy, Refund Policy, and Privacy Policy, which are incorporated here by reference. If you do not agree, please do not use the Site or place an order.

1. Made-to-Order Products

All Nuvar Designs products, including fountains, planters, garden structures, benches, and custom pieces, are built to order after purchase. Because production begins shortly after your order is placed:

Orders cannot be canceled or modified once they have entered production.
We do not accept returns or offer refunds on made-to-order items, except as described in our Refund Policy for items that arrive damaged or with a verified defect.

2. Lead Times

Our standard lead time is approximately 60 days, including production and delivery. Lead times are estimates, not guarantees, and may vary based on product type, customization, order volume, materials, carrier scheduling, weather, and other factors outside our control. Delays do not entitle you to cancel an order that has entered production.

3. Custom Orders and Quotes

Custom sizes, finishes, colors, and designs are confirmed with you in writing (by email) before production begins. Please review all dimensions and details carefully; production follows the approved specifications.
Quotes are valid for 30 days from the date issued unless otherwise stated in the quote.
Custom items are subject to the same no-cancellation and no-return terms as standard products.

4. Pricing and Payment

All prices are listed in U.S. dollars. We reserve the right to change prices at any time; the price in effect when you place your order applies to that order.
Payment is due in full at checkout unless a different payment arrangement is agreed to in writing for a custom order.
Applicable sales taxes are calculated at checkout.
If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel the order and refund any payment received, even after the order has been confirmed.

5. Shipping, Delivery, and Risk of Loss

Shipping within the United States is free. Large items ship by freight carrier with curbside or driveway delivery; an adult must be present to receive the shipment, and a delivery appointment may be required. Please review our Shipping Policy for full details.

You must inspect your shipment at the time of delivery and note any visible damage on the delivery receipt before signing.
Damage must be reported to us within 48 hours of delivery with photos and/or video of the product and packaging. Claims not reported within this timeframe may be denied.
Risk of loss passes to you upon delivery.

6. International Orders

Online checkout is available for U.S. addresses only. International orders are quoted individually; please email nuvardesigns@gmail.com before ordering. International customers are responsible for all import duties, taxes, customs fees, and brokerage charges in their country, and for complying with local import requirements.

7. Natural Materials and Product Appearance

Corten steel is designed to weather and develop a rust-colored patina over time. Patina, color variation, and surface changes are natural characteristics of the material and are not defects.
While the patina develops, rust-colored runoff may stain nearby surfaces such as concrete, stone, pavers, or decking. We recommend placing Corten products on gravel, soil, or a surface you are comfortable with. Nuvar Designs is not responsible for staining of surrounding surfaces.
Product photos are for illustration. Actual finish, color, and texture may vary slightly due to materials, handcrafted fabrication, lighting, and screen settings. Dimensions are approximate and may vary within normal fabrication tolerances.

8. Installation, Use, and Maintenance

You are responsible for the proper placement, assembly, installation, and maintenance of your product, including ensuring a level and adequate base that can support the product's weight when filled with water, soil, or plants.
Water feature pumps must be connected to a properly grounded, GFCI-protected outdoor electrical outlet. Any electrical work should be performed by a licensed electrician in accordance with local codes.
Follow any instructions provided with your product. Water features should be kept filled to the proper level to protect the pump.
You are responsible for obtaining any permits and following any local codes, HOA rules, or property requirements that apply to your installation.
Nuvar Designs is not responsible for damage, injury, or product failure caused by improper installation, improper use, lack of maintenance, modification, accidents, or acts of nature.

9. Warranty Disclaimer

Except as expressly stated in our Refund Policy regarding items that arrive damaged or with a verified defect, products and the Site are provided "as is" and "as available." To the fullest extent permitted by law, Nuvar Designs disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Third-party components, such as pumps, may be covered by their manufacturer's warranty.

10. Limitation of Liability

To the fullest extent permitted by law, Nuvar Designs will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product. Our total liability for any claim related to a product or order will not exceed the amount you paid for that product.

11. Intellectual Property

All content on the Site, including product designs, photographs, text, graphics, and logos, is the property of Nuvar Designs or its licensors and may not be copied, reproduced, or used without our written permission.

12. Use of the Site

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or interfere with the Site. We may refuse service, cancel orders, or restrict access at our discretion, including where we suspect fraud or unauthorized activity.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your purchase will be resolved in the state or federal courts located in Clark County, Nevada.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page. The Terms in effect at the time of your order apply to that order.
